These Terms of Service ("Terms") govern your access to and use of the EmergencyMusician platform, website, and mobile application (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, do not access or use the Platform.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and EmergencyMusician LLC ("EM," "we," "us," or "our"). If you are using the Platform on behalf of a church or organization, you represent that you have the authority to bind that organization to these Terms.
2. Key Definitions

| Booking Fee | A $25 non-refundable fee charged per Gig at the time of booking. |
| Buyout | A Customer's request to engage a Musician directly outside the Platform for ongoing or long-term work, subject to EM's Buyout Fee. |
3. Eligibility & Accounts
- Age. You must be at least 16 years old to use the Platform. Users ages 16–17 represent that they have parent or guardian consent and that local law permits them to work.
- Accurate Information. You agree to provide accurate, current, and complete information and to keep your account details updated. One account per person or entity. Do not share your login credentials.
- Verification. EM may require identity, phone, payment, or tax verification. We reserve the right to deny or suspend accounts that fail verification checks.
- Legal Compliance. You are responsible for complying with all applicable laws, including labor, tax, and licensing requirements relevant to your role on the Platform.
4. EM's Role
EmergencyMusician is a marketplace platform — we connect worship leaders and churches with qualified musicians available for last-minute bookings. We are not a party to the direct agreement between a Customer and a Musician, and we are not an employer, agent, or staffing agency for either party.
- No Performance Guarantee. EM does not control, guarantee, or oversee the quality, timing, or outcome of any individual Gig.
- Internal Vetting. All Musicians on the Platform have been reviewed and approved by EM's internal team. This vetting is not a guarantee of performance or conduct and does not create an employment or agency relationship.
- Shared Responsibility. While EM is not liable for Gig outcomes, we take our role in the worship community seriously. If a confirmed Gig falls through due to a Musician's failure to perform, EM will make reasonable efforts to assist the Customer in finding a replacement. See Section 6 for refund details.
- No Insurance. EM does not provide insurance coverage for Gigs. Users assume responsibility for any injuries, damages, or losses arising from or during a Gig.
5. Payments, Fees & Taxes
- Payment Processor. All payments are processed securely through Stripe. By using the Platform, you agree to Stripe's Terms of Service and Connected Account Agreement. EM does not store or have access to your payment credentials.
- Customer Charges. Customers agree to pay the quoted Gig amount plus the applicable $25 Booking Fee and any applicable taxes at the time of checkout.
- Musician Payouts. Following Gig completion and any applicable review window, EM will instruct Stripe to disburse payment to the Musician. Payout timing may vary based on Stripe's processes, bank processing times, or compliance reviews.
- Taxes. Each party is responsible for their own applicable taxes. EM may issue required tax forms (e.g., IRS Form 1099) to Musicians as required by law.
- Chargebacks. You agree to cooperate with EM and Stripe in resolving payment disputes. Fraudulent or excessive chargebacks may result in account suspension.
6. Cancellations, Rescheduling & Refunds
6.1 Customer-Initiated Cancellations
- Within 24 Hours. If a Customer cancels within 24 hours of the scheduled Gig start time, the $25 Booking Fee is non-refundable. Additional cancellation charges may apply as disclosed at checkout.
- More Than 24 Hours. Cancellations made more than 24 hours before the scheduled Gig start time are eligible for a partial refund of the Gig amount, excluding the non-refundable $25 Booking Fee.
- No-Show. A Customer who fails to appear for a confirmed Gig will be treated as a late cancellation. The Booking Fee is forfeited and the Musician will receive their agreed compensation.
- Rescheduling. Rescheduling requires the mutual consent of both the Customer and Musician and may incur additional charges. Rescheduled Gigs are subject to Musician availability.
6.2 Musician-Initiated Cancellations
- Reliability Standard. Confirmed Musicians are expected to honor all booked Gigs. Cancellations or no-shows by Musicians may result in reduced visibility, account restrictions, or removal from the Platform.
- EM's Responsibility. If a Musician cancels a confirmed Gig, EM will make a good-faith effort to identify and connect the Customer with an available replacement Musician. If no replacement is available, the Customer will receive a full refund of amounts paid, including the Booking Fee.
6.3 EM-Initiated Cancellations
EM may cancel a Gig for risk, safety, fraud, or policy-related reasons. In such cases, Customers will receive a refund of amounts paid, excluding services already rendered or non-refundable fees where applicable.
7. Acceptable Use & Conduct
All users — both Customers and Musicians — agree to:
- Follow all applicable laws and venue rules during Gigs.
- Treat other users with respect. Harassment, discrimination, or threatening behavior will result in immediate removal from the Platform.
- Accurately represent your identity, skills, instruments, and availability.
- Not interfere with the integrity of the Platform through scraping, hacking, spam, or circumvention of fees.
- Respect the intellectual property and confidentiality obligations set out in these Terms.
8. Communication Policy
- Platform Channels. All booking-related communications between Customers and Musicians must take place through EM's approved in-app or platform-provided channels. Conducting Gig negotiations or arrangements off-platform is prohibited unless explicitly authorized by EM in writing.
- SMS & Email. By creating an account, you consent to receive transactional SMS and email notifications related to your bookings and account activity. You may opt out of non-essential communications at any time. Standard carrier rates may apply.
9. No-Circumvention & Buyouts
- No Bypassing. You agree not to circumvent the Platform to avoid paying EM's fees. This includes contacting, engaging, or retaining any Musician you were first introduced to through EM outside of the Platform without paying the applicable Buyout Fee.
- Buyout Option. If a Customer wishes to hire a Musician directly for ongoing, recurring, or long-term engagements outside the Platform, a Buyout Fee applies. Buyout pricing will be disclosed by EM in writing or within the app and is subject to change.
- Enforcement. If circumvention is detected, EM may charge the applicable Buyout Fee to the payment method on file, invoice the Customer, adjust account standing, or pursue other available remedies.
10. Ratings & Reviews
- Public Feedback. Ratings and reviews submitted on the Platform are public and contribute to the trust and accountability of our marketplace.
- No Removal Policy. EM does not remove ratings or reviews upon request. Reviews may only be removed in cases required by law or for clear policy violations (e.g., hate speech or doxxing).
- Truthfulness. You represent that any review you submit is truthful and based on your genuine first-hand experience.
11. Privacy & Booking Confidentiality
- Privacy Policy. Your use of the Platform is governed by our Privacy Policy. By using the Platform, you agree to the collection and use of your information as described therein.
- Booking Confidentiality. Customers and Musicians agree to keep non-public booking details confidential — including agreed rates, private contact information shared through EM, and internal church or event information — except as required by law.
12. Intellectual Property
- EM's IP. The Platform, including its trademarks, content, design, and technology, is owned by EmergencyMusician LLC or its licensors and is protected by applicable intellectual property law. You receive a limited, revocable, non-transferable license to use the Platform solely for its intended purpose.
- Your Content. By submitting content to the Platform (e.g., musician bios, photos, audio samples, set lists), you grant EM a worldwide, non-exclusive, royalty-free license to host, display, and use that content solely to operate and promote the Platform. You represent that you own or have the necessary rights to all content you submit.
- Music Licensing. Musicians are solely responsible for ensuring they have the appropriate licenses or permissions for any music performed during a Gig. EM assumes no responsibility for copyright or licensing compliance during performances.
13. Disclaimers, Limitation of Liability & Indemnification
Indemnification. You agree to indemnify, defend, and hold harmless EmergencyMusician LLC and its team from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Platform, your Gigs, your submitted content, or your violation of these Terms or applicable law.
14. Dispute Resolution & Governing Law
- Informal Resolution. We encourage you to contact us first at Contact@EmergencyMusician.com to resolve any dispute informally before taking formal action.
- Small Claims. Either party may bring a qualifying claim in small claims court in Orange County, Florida without waiving their right to arbitration for other claims.
- Governing Law & Venue. These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. For claims not resolved informally or through small claims court, you agree to the exclusive jurisdiction of state or federal courts located in Orange County, Florida.
- No Class Actions. You agree that any dispute will be resolved on an individual basis and not as part of a class, consolidated, or representative action.
15. Suspension & Termination
- By EM. EM may suspend or terminate your account at any time for violation of these Terms, suspected fraud, safety concerns, non-payment, or legal requirement. We will make reasonable efforts to notify you where appropriate.
- By You. You may stop using the Platform at any time. Outstanding obligations — including scheduled Gigs, unpaid fees, and indemnification duties — survive termination.
- Effect of Termination. Upon termination, your license to use the Platform ends immediately. EM may retain your data as required by law or for legitimate business purposes, as described in our Privacy Policy.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised version with a new "Last Updated" date. For material changes, we will make reasonable efforts to notify you via email or in-app notification before the change takes effect. Continued use of the Platform after any update constitutes your acceptance of the revised Terms.
